ICJ就冈比亚起诉缅甸对罗兴亚种族清洗事件将于本月22日作最终判决

7月11日,联合国国际法院 (ICJ)发布公告,关于冈比亚起诉缅甸对罗兴亚种族清洗事件,将于7月22日下午3点在荷兰海牙的和平宫国际法庭作出最终判决,并由国际法院院长琼·多诺霍法官宣读判决结果。但由于新冠病毒的限制,当天,只有双方代表和法官、法院成员及仅允许少数授权媒体参加,公开听证会将继续关闭。公众可以通过电视平台包括ICJ网站在内的现场直播来检测这一决定。


消息称,关于种族灭绝的起诉,联合国国际法院 (ICJ)曾在民盟政府时期就曾受到昂山素季对缅军领导人敏昂莱任命的哥哥莱领导的一团体提起过诉讼。


针对冈比亚起诉缅甸对罗兴亚种族清洗事件,缅军代表团曾在今年2月25日举行的听证会上否决了此事,并表示联合国国际法院 (ICJ)没有权审理。


据了解,伊斯兰合作组织(OIC)曾提议冈比亚起诉缅甸后,该提议于 2019 年 7 月才获得冈比亚议会的批准,同时,冈比亚也并未否认关于起诉缅甸一事从OIC那里获得的资金。因此,缅军聘请的律师 Christopher Staker表示,联合国国际法院只需对一个国家起诉另一个国家的案件举行听证会,但没有任何权利接受和审理诉讼。



ICJ to issue final verdict on Gambia's prosecution of Myanmar over Rohingya ethnic cleansing


On July 11, the United Nations International Court of Justice (ICJ) issued an announcement that the Gambia sued Myanmar for the ethnic cleansing of the Rohingya, and the final judgment will be made at the Peace Palace International Court in The Hague, the Netherlands at 3 pm on July 22. Judge Joan Donoghue, President of the Court, read the verdict. However, due to coronavirus restrictions, public hearings will remain closed that day with only representatives from both parties and judges, court members and a limited number of authorized media. The public can test the decision through live broadcasts on TV platforms including the ICJ website.


Sources said that the United Nations International Court of Justice (ICJ) had brought a lawsuit against a group led by Aung San Suu Kyi against a group led by her brother Rai, appointed by Myanmar army leader Min Aung Hlaing, during the NLD government.


In response to the Gambia's prosecution of Myanmar's ethnic cleansing of the Rohingya, the Myanmar army delegation rejected the matter at a hearing held on February 25 this year, saying that the United Nations International Court of Justice (ICJ) has no jurisdiction.


It is understood that after the Organization of Islamic Cooperation (OIC) proposed that the Gambia sue Myanmar, the proposal was only approved by the Gambian Parliament in July 2019. At the same time, the Gambia has not denied that it has received funds from the OIC for the prosecution of Myanmar. Therefore, Christopher Staker, a lawyer hired by the Tatmadaw, said that the UN International Court of Justice only needs to hold hearings in cases where one country sues another country, but it does not have any right to receive and hear lawsuits.
